These Terms and Conditions ("Terms") govern your access to and use of the website, products, and services provided by T&M Hose & Hydraulics LLC, doing business as T&M Hose & Fittings LLC ("Company," "we," "us," or "our"), including the sale of standard and custom hose assemblies, fittings, hydraulic components, and the provision of on-site field services within East Tennessee. By accessing our website or purchasing our products or services, you agree to be bound by these Terms. If you do not agree, do not use our website or services. 

You represent that you are at least 18 years of age and have the legal authority to enter into binding agreements. You agree to use this website for lawful purposes only and not in a way that violates any applicable laws or regulations.

2.1 Standard and Customized Hose Assemblies

• We offer both standard and custom-fabricated hose assemblies.

• Customized products are made to order based on customer-provided specifications and may not be returnable or refundable, except as required by law or as otherwise stated in writing.

• It is the customer’s responsibility to ensure that all specifications (including size, pressure rating, temperature rating, materials, fittings, and application) are accurate and suitable for the intended use.

2.2 Standard Hydraulic Fittings & Adapters​

• We offer industry-standard hydraulic fittings and adapters from our partner brands.

• These items are distributed products and should be inspected before installation on your equipment.

2.3 Field Services

• Field services are provided on-site within East Tennessee and may include hose replacement, installation, inspection, and related support.

• Service availability is subject to scheduling, weather conditions, site access, and safety considerations.

• You are responsible for providing safe access to the worksite and disclosing any known hazards prior to service.

• All orders are subject to acceptance by the Company.

• We reserve the right to refuse or cancel any order for any reason, including errors in pricing, product availability, or suspected misuse.

• Once an order for a customized hose assembly has entered production, it may not be canceled.

• Prices are listed in U.S. dollars unless otherwise stated.

• Prices, product availability, and service fees are subject to change without notice.

• Payment is due at the time of purchase unless otherwise agreed in writing.

• You are responsible for all applicable taxes, fees, and shipping or service charges.

• Shipping dates and lead times are estimates only and not guaranteed.

• Risk of loss and responsibility for products pass to you upon delivery to the carrier or upon on-site installation, as applicable.

• The Company is not responsible for delays caused by carriers, suppliers, or events beyond our reasonable control.

• You must inspect products and services upon receipt, before installation or service completion.

• Any claims for shortages, defects, or non-conformity must be reported in writing within 7 days of delivery or service completion.

• Failure to notify us within this period constitutes acceptance.

• Standard (non-custom) products may be eligible for return, subject to approval and restocking fees.

• Customized hose assemblies and field services are non-refundable, except in cases of proven manufacturing defect or Company error.

• Returned items must be unused and in original condition unless otherwise approved.

8.1 Limited Warranty

• Products are warranted only to the extent of the original manufacturer’s warranty, if any.

• Field services will be performed in a commercially reasonable and workmanlike manner. We provide a 30-day limited warranty on our work, covering any company-provided and installed custom hose assemblies that are proven defective. 
   

8.2 Disclaimer

• EXCEPT AS EXPRESSLY STATED, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."

• WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• To the fullest extent permitted by law, the Company shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, downtime, or business interruption.

• The Company’s total liability for any claim shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

• You acknowledge that hose assemblies are safety-critical components and improper selection, installation, or use may result in serious injury or property damage.

• You are responsible for proper application, installation, inspection, maintenance, and compliance with all applicable standards and regulations.

• The Company is not responsible for failures resulting from misuse, improper installation, modification, or operating conditions outside the product’s specifications.

You agree to indemnify, defend, and hold harmless the Company and its owners, employees, and contractors from any claims, damages, losses, or expenses arising out of your use of the products or services, your breach of these Terms, or your violation of any law or regulation.

All content on this website, including text, images, logos, and designs, is the property of the Company or its licensors and may not be used without prior written permission.

These Terms are governed by the laws of the State of Tennessee, without regard to conflict-of-law principles. Any legal action shall be brought exclusively in the state or federal courts located in Tennessee.

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the website. Your continued use of the website or services constitutes acceptance of the revised Terms.
